Terms of Service

This User Service Agreement (the “Agreement”) is a binding contract between you and One Black Moblie Limited (“we”, “us”, or “our”). It pertains to your usage of our digital application (the “App”) and related services (the “Service”). This Agreement does not encompass third-party websites or services, even if they are accessible through our Service.

By accessing or using our App, you are consenting to the terms and conditions in this Agreement. If you do not agree with this Agreement, please stop using the App immediately.

Please be aware that we may revise this Agreement concerning updates to our App. You can review any changes to this Agreement within the App. If you continue to use our App after changes have been made to the Agreement, we will consider it as your acceptance of the updated terms.

Intellectual Property Rights
1.1. With all copyrights, trademarks, patents, business secrets, and related rights, titles, and interests associated with the App, we assert that we are the sole developers of it. Unless otherwise stated, the App, as well as any related information such as text, icons, images, and electronic documents, are under protection of copyright, trademark, patent laws, and international agreements in the relevant country.

1.2. You shall not infringe on our intellectual property rights, including the exploitation or assignment of them. If there is infringement, we withhold the right to pursue legal action.

1.3. Without our prior written consent, you agree not to reverse engineer, decompile, or levy upon the source code of the App. Any infringement detected will be legally pursued.

Licence of the App
2.1. We grant you a non-exclusive, non-transferable, and revocable license for non-commercial, personal use of the App on mobile devices.

2.2. The App must not be used unlawfully or commercially exploited in any way. You must not cause harm to the App or its related service.

2.3. By using the App, you agree not to duplicate or sell the App or Service to others. You are fully responsible for all costs arising from these actions.

2.4. We reserve all rights not expressly granted to you and can terminate your license at any time at our discretion.

Privacy
Please refer to our Privacy Policy for information on how we handle your personal data.

User Age Restrictions
The App does not target underage users. If underage users access the App, we require parental consent and supervision.

Paid Service
5.1. Payment for any paid services offered (“Paid Service”) can only be made using a valid and accepted method of payment. It is your responsibility to adhere to the terms of service relating to your selected payment method. Prices may change, and we do not offer price protection or refunds for a price decrease or promotional offer.

5.2. No refunds will be issued once a Paid Service has been purchased, regardless if the service is used or not.

Disclaimer and Limitation of Liability
We are not responsible for any risks such as system failures, hacking, or other technical issues that could disrupt the App. We are not liable for any losses arising from technical problems or unforeseen circumstances. We have the right to amend or terminate the Service at any time without prior notice.

Indemnification
You agree to indemnify and hold us harmless from all claims or causes of action related to the misuse of the App, the violation of laws, or rights of third parties.

Miscellaneous
8.1. You may not assign this Agreement without our prior written consent.

8.2. The Agreement is governed by the laws of the People’s Republic of China. The resolution of any disputes arising from these Terms will be settled by the China International Economic and Trade Arbitration Commission (“CIETAC”) South China Sub-Commission.

8.3. We reserve the final right of interpretation for this Agreement.
